As an indirect way of admitting Kiir violated the Constitutions,The government in Juba has taken unprecedented step to temper with and amend the interim constitution of 2011 to suit the interest of the president and the JCE. On Tuesday morning south Sudan’s Minister of Justice, Paulino Wanawilla, has presented a bill in the National Legislative Assembly ( parliament) in Juba to amend the transitional constitution of 2011. President Kiir is seeking to alter the existing of 10 states into 28. His critics said Kiir perhaps realized the tough and difficult journey before his cabinet to convince the people of south Sudan as the transitional constitution of 2011 clearly stipulated that south Sudan is a nation of 10 historical states. If the amendment passes through as expected without any obstacle, it is simply because the house is controlled by MPs from Kiir’s Baharal Ghazal boys.
While presenting the bill to the national legislative assembly (parliament) on Tuesday morning, Mr Wanawilla urged the law makers to remember that the constitution has to be amended to meet what he calls new extension of decentralization. He urged that this is a peoples call and President kiir is now responding to those calls.
He said the President of the Republic has responded to the popular calls by the people, by restructuring the current form of the existing state. In the view of the Justice Minister Wanawilla this is democratic reform to further distribute power and resources, he said under the president creation of 28 state will decentralized power from the national government to the state local governments.
He said during his presentation of the bill that it is therefore, necessary that certain articles of the transitional constitution 2011 be amended to meet this new realities of the decentralized system of Government. This is contrary to the meaning of constitution, its sole purpose is supposed to be used as a mirror to guide the country and everyone to mold their behaviors according to it rather molding and twisting the constitutions to fit us. Now if the constitution should be subjected to amendment to suit the interest of one single man there is no need to have a constitution because the constitution is a collective opinion of the general population to guide everyone but more so those in power.
After the presentation, the Speaker of the National Legislative Assembly, Manasse Magok Rondial, referred the bill to the special committee of legislation and legal affairs. He said the two committees of justice and human rights will assist in studying the bill. And the committees will report back to the legislature within 30 days.
The decision to present the bills of amendment of interim transition of 211, comes days after the National Alliance of consisting of various political parties under the chairmanship of Dr Lam Akol petitioned the Supreme Court to stop the implementation of the order of creating additional 18 state and to declare it illegal, unconstitutional and invalid.Justin S.
